1. Introduction

The web portal of MDIA is maintained and administered by the Malta Digital Innovation Authority (‘MDIA’. MDIA is established by virtue of the Malta Digital Innovation Authority Act, Chapter 591 to seek the development of  the  innovative technology sector in Malta through proper recognition and regulation of relevant innovative technology arrangements and related services.

In using the web portal of MDIA, the user is indicating his agreement and consent to be bound by these terms and conditions and that MDIA may from time to time alter any part of this web portal, or any of the services or products which is provided through this web portal, as it thinks adequate and fit, at any time and without prior notice to the user.

2. What information is kept when using MDIA’s website and for what reason

When the user visits MDIA’s web portal, a record of the user’s visit is kept for statistical and research purposes. This helps MDIA know which aspects of its site are the most visited. Similar records may be kept when users makes use any of the interactive features of MDIA’s web portal. The information kept includes the user’s: server address , top-level domain name (e.g. .com, .net, .uk), the date and time of the visit on the website, the pages of the site that were accessed, the documents downloaded, the previous site that was visited, and the type of web browser used by the user

MDIA will not use this information for identification purposes. However, this information may be used for this purpose in the unlikely event that a government law enforcement body or other similar party obtains and exercises a warrant, subpoena, or similar legal order to obtain access to our service provider’s logs.

The website of MDIA may provide information on third parties such as, systems auditors and technical experts. Although the information provided on the web portal is to the best of MDIA’s knowledge is correct, MDIA does not make any representation as to their accuracy. MDIA disclaims liability and responsibility for any and all loss, damage, or inconvenience suffered by any person, company, corporation or partnership or other entity as a result of use of such contact and descriptive details, as provided in this web portal. Anyone proposing to use or rely on such information should seek confirmation of the accuracy and currency of such information directly from the operator concerned. The user hereby agrees that the use of the information provided therein is at his/its own risk and responsibility.

4. Exemption from Liability

MDIA shall not be liable for any damages (including but not limited to damages resulting from loss of business or loss of profit) arising in contract, tort or otherwise, from the use or inability to use this web portal, or any link contained therein, or from any action or decision taken as a result of using such web portal or any link, material or information contained therein. The same applies to any information about third party products and services contained in electronic news bulletins or other forms of communication or any links contained therein.

MDIA shall have no liability towards any person for any loss or injury (including but not limited to personal injury and consequential loss) suffered while participating in any of the products or services offered by MDIA including but not limited to schemes and initiatives of the MDIA. The user is responsible for informing himself or herself of any and all inherent risks.

5. Miscellaneous

In the event that any of terms and conditions contained herein shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term and conditions shall to that extent be severed from the remaining terms and conditions, contained herein which shall continue to be valid to the fullest extent permitted by law.

These terms and conditions shall be governed and construed in accordance with Maltese law and all disputes relating to the performance or interpretation of any term or conditions contained herein shall be subject to the exclusive jurisdiction of the Maltese Courts and Tribunals.
